Abstract

Our regional government, through the introduction of the Regulation 5/99 on Urban Development (LUCyL) has established five ways of action � compensation, cooperation, expropriation, agreement and concurrence. In all of them the planning project appears as the technical instrument for the management of both unconsolidated urban and building land. Among these ways of action, compensation has been chosen for this thesis as the means or instrument of distribution of both the profits and charges among the owners. It has also been chosen as the means or instrument for the achievement of the essential content of the right of ownership and its limits, as regards the other owners and the target citizenry of the capital gains generated by the urban development
