Abstract
Within the context of the ambitious projects and educational initiatives defining the building of the European Higher Education Area, we approach the thesis which closely links "the Europe for Citizens" and its focus on lifelong learning with the legal regulation of university programs for older people. Based on the analysis of Social transformations, European common policy guidelines and the pedagogical reality of the University programs for older people, which provide enough features to require the legal protection of the University training of older people as a right, we review the possibilities and boundaries of the legal framework for the training of older people with the aim of fixing whether such legal framework, currently in force, has achieved the requirements and demands of our society, or otherwise, the efficiency principle still has not been satisfied with legislation on the field of lifelong learning.
