Abstract

The purpose of this paper is to carry out a study of the conciliation paper and its status as a prerequisite for the processing of the process. Therefore, the procedural legislation and case law of the different national judicial bodies will be analyzed in order to understand the possibility of filing the lawsuit before the conciliation ballot, as a way to avoid the expiration or prescription of the action. Thus, it is observed that the procedure for the correction of claims facilitates the rule of commutativity in the social order, being able to establish the prior conciliation in an order subsequent to the filing of the lawsuit.
