Abstract

Penal mediation is still identified with restorative justice when the latter is all‐encompassing of the former or when the former is translated into restorative justice for countries attached to the legal tradition of Civil Law such as Spain. In any case, a legislative anomie still survives in general terms, which will soon or later have to be «repaired» because penal mediation in our country exists and is practised. For this reason, we would like to make a brief reflection on the state of play to date from an international, European and national perspective.
