Abstract

Following the recent judgment of the Court of Justice of the European Union (hereinafter, CJEU) in the O.G. case of 6 June 2023, in this contribution we analyse the CJEU’s interpretation of one of the grounds for refusal to execute the EAW provided for in Article 4.6º of Council Framework Decision 2002/584/JHA of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States. For the CJEU, respect for the fundamental rights of the subject of the EAW, including equality before the law, must take precedence over the automatic application of this instrument of mutual recognition.
