Abstract

This paper examines the Judgment of the Court of Justice (Seventh Chamber) of 21 December 2023, Case C 398/22 (hereinafter STJUE) which concerns a reference for a preliminary ruling from the Higher Regional Court for Civil and Criminal Matters in Berlin, Germany (Kammergericht Berlin) in proceedings concerning the execution of a European Arrest Warrant (hereinafter EAW). An interpretation is sought of Article 4a (1) of Council Framework Decision 2002/584/JHA of 13 June 2002 on EAWs and surrender procedures between Member States, as amended by Council Framework Decision 2009/299/JHA of 26 February 2009 to strengthen the procedural rights of individuals and to facilitate the application of the principle of mutual recognition to decisions rendered following a trial at which the accused did not appear in person. The questions referred for a preliminary ruling are twofold: the first concerns the concept of «judgment giving rise to the decision» in accordance with the aforementioned Article 4a; the second concerns the principle of the primacy of the European Union (hereinafter EU) if it conflicts with national legislation such as that at issue in the main proceedings, which excludes the enforcement of the EAW by the executing authority.
