Abstract

In this study, the way in which the primitive and original rigidity of the principle salva rerum substantia was moderated over the passage of time is analyzed. It is not only noted in the Roman legal sources themselves, which already showed a flexible development of the principle as a consequence of jurisprudential intervention, but also because of the necessary acceptance of the regulation quasi ususfructus. As a result of the reception of Justinian Law, examples of usufructuary may be appreciated in the current legal order that although not completely disregarding the principle salva rerum sustantia at least highlight its absolute elasticity, in other words, its flexibility in adapting to the established legal order. Nevertheless, what is fundamental in the law of usufruct are the rights of the usufructuary, uti et frui, the limit salva rerum substantia being secondary, as it is variable and modifiable, although no less important for that reason.
