Resumo

The objective of this study is to know who has to bear any damage to the object of the legacy under all those circumstances of loss, deterioration, or detriment that are encompassed under the concept of risk. To do so, we centre on the reception of the periculum legatarii from its definitive regulation in Justinian Law up until the most recent legal text in which it is contemplated: the Civil Code of Catalonia. Legacies can, because of their legal effects, be real or in the form of obligations. Under both assumptions, the legatee will assume all losses, deterioration or detriment affecting the object of the legacy, to which the heir or person encumbered with the legacy is not obliged to respond. That principle has been definitively expressed in the Justinian phrase: Si res legata sine facto heredis perierit, legatario decidit.
